April 3, 2008 10:00 A.M. The meeting was called to order by Chairman Odell Flaagan with Commissioners Fougner, Bergquist, Dahlen, and Lofthus present. Moved by Commissioner Dahlen and seconded by Commissioner Fougner to approve the minutes as distributed. All voted "Yes". Motion carried. Susan Bergquist presented the proposed Home Rule Charter as approved by the Home Rule Charter Commission. Moved by Commissioner Lofthus and seconded by Commissioner Fougner to approve the proposed Home Rule Charter as presented. All voted "Yes". Motion carried. Rick Urvand presented the North Dakota Association of County's "Common Ground" newsletter, the "Blading Aggregate Surfaces" training guide, and a Department of Transportation letter regarding right of way encroachment on County Roads. Rick discussed contracts for Township road maintenance, sign refurbishing, Keystone Pipeline haul roads, asphalt and road tar costs, credit cards, a map of Stump Lake Park, and right of way recordings. There was discussion on the Tolna Dam repair project and the ownership of the dam. Greg Daws asked about a time to discuss ways to save the county money. Because time was short, he was asked to get on the agenda at a future meeting. Sharon Young discussed the State Spelling Bee, the Flood Insurance Rate Map meeting, Mutual Aid Agreements, the Hazardous Material Awareness Course, the Evacuation/Sheltering/Mass Care Plan Course, the Public Information System Course, the SkyWarn Storm Spotters Course, Severe Summer Weather Awareness Week, the 2008 Emergency Management Performance Grant, the City Watch program, and protocol when the Emergency Manager is unavailable. Keith and Darlene Forde discussed their protest of taxes on land under water, some of the land that is in CRP, and not having to apply every year for inundated agricultural land. Herb Schultz stated that in other Townships, the landowners apply every year. Keith and Darlene need to complete the inundated agricultural land application for land not in CRP. Applications and abatement forms will be sent to them. Kelly Janke presented the Calls for Service report and discussed the replacement of the shotguns, the contract policing meeting, a possible search and rescue boat, a stolen vehicle, and other incidents. Moved by Commissioner Bergquist and seconded by Commissioner Fougner to acquire a boat from the Federal Defense Reutilization and Marketing Services program at no cost. All voted "Yes". Motion carried. Herb Schultz discussed credit card usage. Election issues were discussed. Moved by Commissioner Lofthus and seconded by Commissioner Bergquist to pay the election officials $8.00 per hour and $10.00 per hour if they attend the training. All voted "Yes". Motion carried. Moved by Commissioner Lofthus and seconded by Commissioner Bergquist to place the adoption of the proposed Nelson County Home Rule Charter on the June 10, 2008, Primary Election ballot. All voted "Yes". Motion carried. Sharon Young reviewed the mutual aid agreements from Eddy and Pembina Counties. Steve Simonson discussed the proposed Home Rule Charter and mutual aid agreement. Michelle Linstad discussed assessing the City of McVille and the implementation of the soil survey. A letter from Larry Johnson regarding his application for a grant from the Job Development Authority for prep work for a millwright shop was reviewed. There was discussion on the NDIRF election and zoning issues. At 9:00 A.M. bids were opened for gravel from Soper Construction, Gabriel Construction, Heck Trucking & Construction, and Don Dvorak Gravel. Moved by Commissioner Dahlen and seconded by Commissioner Lofthus to accept all bids for gravel. All voted "Yes". Motion carried. At 9:30 A.M. bids were opened for culverts from Cretex Concrete Products and Johnston Fargo Culvert. Moved by Commissioner Lofthus and seconded by Commissioner Fougner to accept the bids from Cretex Concrete Products for concrete culverts and Johnston Fargo Culvert for metal culverts. All voted "Yes". Motion carried. Rick Urvand discussed the purchase of a used grizzly for separating dirt from rocks. Moved by Commissioner Fougner and seconded by Commissioner Bergquist to purchase a used grizzly from Lake Region Asphalt. All voted "Yes". Motion carried. At 10:00 A.M. one bid was opened for petroleum products. Moved by Commissioner Dahlen and seconded by Commissioner Fougner to accept the bid for petroleum products from Farmers Union Oil of Devils Lake. All voted "Yes". Motion carried. At 10:30 A.M. bids were opened for weed control chemicals from S&S Agri Service and Cenex Harvest States. Moved by Commissioner Dahlen and seconded by Commissioner Bergquist to accept the bids from S&S Agri Service for Tordon and No Drift additive and Cenex Harvest States for 2-4D Amine & Curtail.
